It's a pretty long-standing principle. Not a surprising decision at all.

The reasoning for the dissents is interesting, I think, and shows how a decision might not be defined by Left-Right.

Why would anybody respect the rule of law in the US?

FBI - corrupt
CIA - corrupt
DNI - corrupt
DOJ - corrupt
NSA - corrupt
Congress - corrupt

You might want to note who dissented, and why, before posting.

I tend to side with Neil Gorsuch in this

"A free society does not allow its government to try the same individual for the same crime until itâ€s happy with the result," he said.

"X wrote that under the Constitution, it is the governed, not the governments, who are the ultimate sovereigns."

I wonder who wrote this in a dissent.

It's called 'do over'. Same burfle the left is trying with Trump. His case isn't unique in that the 'evidence' was manufactured out of thin air. There is a reason 94% of state indictments and 95% of federal indictments are plead out.

Our Justice System has morphed into an outcome based setup. Just don't say this in front of a lawyer posing as a professor. He might take offense and walk out of the classroom.

Beings that there were only 2 dissents....and I quoted the one.....it must be the other one.  Which people would be shocked at.

I'm going to help JW since he either didn't read the dissent or is not willing to post RBG's name.

JW of course thinks this is some long standing principle, which is in line with his usual contributions.

SCOTUS doesn't bother with long standing principles with very rare exceptions. The Constitution is not clear on this point, hence the 7-2 vote with 2 reasoned dissents.

Constitutional or not it doesn't sit right with me. It is double jeopardy the courts just found a legal loophole.
