You may recall we had a poster who once bought an SKS, but the description sounded pretty sketchy.

He bought it at a gun show from an unlicensed dealer who had dozens for sale, or so he said.
I was making the point that dealers at gun shows are FFLs, or antique sellers, not just some guy out of a pickup truck. Most gun shows require dealers to be FFLs. The language on the regulation is a bit vague, but "dozens" would make that person an unlicensed dealer.

This story is receding in the news faster than I expected. CBSNews claims he bought the weapon in Nevada legally. That would not be legal unless he had it shipped to a CA FFL.

It is technically true everywhere, but renting space at a gun show costs a fair bit of money. How many guns can an individual sell to recoup that? By the time he brings in say 6 guns, he's arguably becoming a dealer (the rules on that are unclear). If you have "dozens" for sale, the individual exception for selling guns is pretty clear exceeded and you now are an UNLICENSED firearms dealer. The larger gun shows in Ohio REQUIRE venders to have an FFL. They don't mess around with it, they could arguably be liable. The antique dealers don't have to have a license. So, while there is a technical "gun show loophole", it really barely exists for obvious reasons. An individual out there with multiple guns to sell turning a profit by that technique each year is illegal under Federal law. He could sell a few privately owned guns but not buying and selling.
